Today was the first day of the re-opened ShareConnector Trial in Rotterdam, Netherlands. P2PViNE will have a full update from Adi when the trial finally concludes hopefully in a few days. For various legal reasons P2PViNE cannot publish all the development’s/facts while the trial is underway but for now here is what happened today.

9th July Update From Adi at ShareConnector

I won’t go into details since its not significant, what matters is that they still see us as a criminal organization which professionally breaches copyright on massive scale.

The today’s case begun with my presentation about what eD2k links are, explaining the whole story about “Identifiers” vs. “Locators” and the way ShareConnector works.

Unfortunately the jury wasn’t wise enough to see the difference between those 2 different things and thinks its just a link pointing to a file like with HTTP.

At the end of the case the public prosecutor came with her plea which had so many flaws that at some point I was laughing.

The funny thing was they said our ISP was active on the forums ripping and sharing music albums under the nickname “Megadeath” which seems to be a registered forums user, while our ISP had the nickname “ISP”.

The Public Prosecutor’s Department demands 5000 euro fines plus conditional jail sentences of a half year against the administrator and former ISP of ShareConnector.

All the charges are based on wrong information, without any facts and not to mention evidence.

At its least her plea was weak and something to have a good laugh at. Tomorrow is our turn to break those accusations and show them our plea.

As you can see the biggest hurdle seems to be getting the courts to understand that an eD2k link is not a direct HTTP link to the file. This case is really interesting because Adi and ShareConnector are the first eD2k Indexing site that has taken a stand against legal action. The outcome of this case will finally set a precedent for others if they come along in the future.
